Welcome to LocaliveMusic ("App," "Service," "we," "our," or "us"), operated by Lagoon Web, LLC. By accessing or using the App, you agree to these Terms of Use. If you do not agree, please do not use the Service.

These Terms govern your use of the App, website, and related services.

1. Eligibility

You must be at least 13 years old to use LocaliveMusic. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate.

2. User Accounts

Certain features require creating an account.

You agree to provide accurate information, including name, email, birth date, and address.

You are responsible for keeping your account credentials secure and for all activity under your account.

You may delete your account at any time. When deleted, your personal data is permanently removed from our active systems.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful or unlawful activity.

3. User Roles

LocaliveMusic supports three user roles:

  • Artist - can post events, photos, videos, and profile information.
  • Venue - can post events, photos, videos, and profile information.
  • Fan - can view events, profiles, and interact with other users.

Each role may have access to different features within the App.

4. Acceptable Use

By using the App, you agree not to:

  • Spam or mass message other users
  • Post illegal, abusive, or harmful content
  • Harass, bully, or threaten other users
  • Impersonate any person or entity
  • Reverse-engineer, decompile, or attempt to extract source code from the App

Violation of these rules may result in content removal or account suspension/termination.

5. User Content

You retain ownership of content you post (photos, videos, events, profile info, messages).

By posting content, you grant Lagoon Web, LLC a non-exclusive, worldwide, royalty-free license to display, host, and distribute it within the Service.

Content may be publicly visible to other users and visitors.

We are not responsible for user-generated content and do not guarantee its accuracy or safety.

6. Messaging

If you use messaging features:

  • You are responsible for messages you send.
  • Harassment, spam, or abusive messaging is strictly prohibited.
  • We may monitor or remove messages that violate these Terms.

7. Payments and Subscriptions (Future-Proof)

The App is currently free.

If paid features, subscriptions, or in-app purchases are introduced:

  • Payments will be processed via third-party providers such as Stripe or RevenueCat.
  • Refunds will be handled according to the payment processor's policies.
  • Users must comply with all applicable terms for third-party payment processors.

8. Push Notifications

The App may send notifications for:

  • New event alerts
  • Event reminders
  • Messages
  • Account activity
  • Marketing or promotional updates

Users can disable notifications in their device settings.

9. Warranties and Liability

The App is provided “as-is” and “as available”. We make no guarantees regarding uninterrupted service, accuracy of content, or suitability of the App.

Lagoon Web, LLC is not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or user-generated content.

10. Dispute Resolution and Governing Law

These Terms are governed by the laws of Florida, United States. Any disputes must be resolved in courts located in Panama City Beach, Florida, or via arbitration as mutually agreed. You consent to the jurisdiction of these courts for any legal matters relating to the App.

11. Modifications to Terms

We may update these Terms at any time. Continued use of the App after changes indicates your acceptance of the updated Terms. Users are encouraged to review these Terms periodically.

12. Termination

We may suspend or terminate accounts at our discretion for violating these Terms or engaging in harmful or illegal activity. Users may delete their accounts at any time; deletion is permanent and removes personal data from active systems.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect, how it's used, and your rights regarding your data.
